Terms of Service

1. Introduction
Welcome to Collabverse ("Platform"), operated by Collabverse ("we", "us", "our"). These Terms of Service ("Terms") govern your use of our platform at collabverse.in and related services.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. Definitions
- Platform: The Collabverse web application, API, and related services.
- Brand: A business entity registered on the Platform to find and collaborate with creators.
- Creator/Influencer: An individual registered on the Platform who creates content for brand collaborations.
- Campaign: A brand's request for content creation with specified deliverables and budget.
- Agreement: The auto-generated digital contract between a Brand and Creator for a specific collaboration.
3. Eligibility
You must be at least 18 years old to use this Platform. Brands must be a valid Indian business entity. All users must provide accurate information during registration and KYC verification.
4. Account Registration
Accounts are created via passwordless OTP authentication. Each user may have one role (Brand or Creator) per account. You are responsible for maintaining the security of your phone number and email used for login.
5. Platform Role
Collabverse acts as a marketplace intermediary. We are NOT an employer of creators, nor an agent of brands. We facilitate connections, provide legal templates, and process payments, but the collaboration itself is between the Brand and Creator.
6. Brand Obligations
- Provide accurate campaign information (deliverables, timelines, budget)
- Make timely payments through the Platform's payment system
- Provide honest and fair reviews of creator work
- Comply with advertising disclosure requirements
7. Creator Obligations
- Deliver original content that meets agreed specifications
- Meet agreed deadlines
- Maintain accurate follower/engagement data (verified via API)
- Disclose sponsored content as required by law
8. Commission & Fees
The Platform charges a commission on successful collaborations. Commission rates are displayed to both parties before payment is processed. Rates may vary and will be communicated clearly.
9. Payment Terms
Brands pay via Razorpay. Creators receive payment via UPI after content is approved by the Brand. Payment processing is handled by Razorpay - we do not store credit card details.
10. Content Ownership
Creators retain copyright to their content unless the Agreement specifies otherwise. Brands receive a license to use the content as specified in the Agreement.
11. KYC Requirements
PAN card verification is mandatory for all users. Additional KYC documents may be required. All documents are stored securely and encrypted.
12. Account Termination
We may suspend or terminate accounts for violations of these Terms. Users can request account deletion at any time. Active agreements must be completed or cancelled before account deletion.
13. Dispute Resolution
Disputes should first be raised through the Platform's dispute system. If unresolved, disputes will be settled through arbitration in accordance with Indian law.
14. Limitation of Liability
The Platform is not liable for the quality of content produced, missed deadlines between parties, or any direct losses arising from collaborations. Our liability is limited to the commission fees collected.
15. Refund & Cancellation Policy
The following sections outline the cancellation and refund terms for campaigns conducted through the Platform.
15.1 Campaign Cancellation by Brand
- Before any offers accepted: Full cancellation, no charges.
- After offers accepted but before payment: Brand may cancel. Existing agreements are voided.
- After payment captured but before content approval: Refund minus platform fee, or dispute resolution.
- After content approved and payout released: No refund (service has been delivered).
15.2 Campaign Cancellation by Creator
- Before accepting offer: No impact on either party.
- After accepting but before payment: Agreement is voided.
- After payment captured: Brand can request content revision or raise a dispute.
- Non-delivery: Full refund to brand. Creator may be penalized (trust score reduction, possible suspension).
15.3 Platform Fee Refunds
Platform fees are non-refundable once services have been rendered (matching, agreement generation). Exceptions may be made in cases of platform error or system failure.
15.4 How to Request a Refund
- Refund requests must be made through the Platform's dispute system (not via email)
- Requests must be filed within 30 days of the disputed event
- Supporting evidence is required for all refund claims
15.5 Processing Time
- Refund decisions: Within 7 business days of dispute filing
- Refund to bank: 5-10 business days after approval (Razorpay processing time)
16. Changes to Terms
We may update these Terms with 30 days notice via email. Continued use after changes constitutes acceptance.
